Residents convicted for failing to comply with Community Protection Notice

Two Ashfield residents have been convicted for failing to comply with a Community Protection Notice as they failed to dispose of excess waste in their garden.

Kevin Mills and Elizabeth Overton-Mills, of Percival Crescent, Sutton-in-Ashfield were convicted following ongoing concerns from residents being raised with the Councils Anti-Social Behaviour team.

The Anti-Social Behaviour team had visited the property on a number of occasions following reports of a large amount of waste in the garden of the property that was attracting rats and undesirable smells.  Failure to remove the waste resulted in them being served a Community Protection Notice, under the Anti-Social Behaviour, Crime and Policing Act 2014.

Having ignored the Notice and failing to remove the waste the Council commenced criminal proceedings. At the hearing on Tuesday 8th September 2020, Nottingham Magistrates imposed a fine of £440 each, they were ordered to pay a victim surcharge of £34 each as well as £250 court costs, to be paid within 28 days. The Court also made a remedial order to the defendants to remove all waste within 28 days.

Cllr Helen-Ann Smith, Cabinet Member for Community Safety said “This conviction shows that we will not tolerate anti-social behaviour from any residents. This couple thought they could get away with ignoring the Community Protection Notice, but we will pursue court action for those that think they are above the law.

“As Ashfield District Council tenants they have also broken their Tenancy Agreement so we will be taking action off the back of their conviction. The Anti-Social Behaviour team have worked hard on this case and it should act as warning to those that think they will get away with behaviour like this.”
