Request a case review

The introduction of the Anti-Social Behaviour (ASB), Crime and Policing Act 2014 replaced various legislation and was designed to include a greater focus upon the impact of anti-social behaviour on victims, and on victim’s needs, as well as streamlining tools and powers.

Whilst we all continually strive to provide a high level of service, we recognise that there are occasions when we don’t get it right first time. This is where the ABS case review comes in (previously known as the Community Trigger).

The Act introduced a case review process for victims of anti-social behaviour. This process is known as the ASB case review.

What is the ASB case review?

The ASB case review gives those affected by anti-social behaviour the right to request a case review of the response to their reports of anti-social behaviour. A case review should only be used if you think your concerns have not been dealt with, or acted upon, by agencies.

Concerns about individual officers, or services, should continue to be directed to the relevant organisation’s complaints procedure and/or the Ombudsman or the Independent Police Complaints Commission.

When can I use a ASB case review?

To activate the ASB case review, all of the following criteria needs to be met:

  • 3 complaints of anti-social behaviour in the last 6 month period with the most recent complaint being made within the last month
  • you feel that no or insufficient action has been taken
  • you are an individual, a business or a community group.

You can activate an ASB case review on someone else’s behalf but the individual concerned must give you their consent to do so.

How do I use the ASB case review?

In order to request a case review, you must download an application form from the related documents section of this page, complete and return it to us.

Completed forms should be returned to:

Community Protection Team
Ashfield District Council
Council Offices
Urban Road
Kirkby in Ashfield

If you require a hard copy of the ASB case review application form or if you require further assistance with completing the ASB case review application form contact us by:

  • telephone: 01623 457345.

What happens when I submit an ASB case review application form?

When a completed application form is received, we will acknowledge receipt of your request within 5 working days.

We will review the information you have provided, to determine whether your case meets the threshold. You will be updated as to whether the threshold has been met.

If it does, an Anti-Social Behaviour Case Review will take place. This will involve agencies sharing information, such as the police, housing, environmental health, social care and health providers, depending on the nature of the case. The anti-social behaviour case review will discuss the issues you raise, consider what action has already been taken and consider recommendations for additional action to resolve the problem. The applicant(s) do not attend these meetings.

We will inform you of the outcome and recommendations of the anti-social behaviour case review.

If you are not satisfied with the outcome of the review, you can lodge an appeal with the Office of the Police and Crime Commissioner for Nottinghamshire.
