Resident prosecuted for breaching a Community Protection Notice
A Kirkby resident has been prosecuted by Ashfield District Council for breaching her Community Protection Notice.
Jade Leeder of Beacon Drive, Kirkby-In-Ashfield, was convicted in April 2021 at South Derbyshire Magistrates Court for breaching her Community Protection Notice, under the Anti-Social Behaviour, Crime and Policing Act 2014 due to ongoing noise nuisance from her address.
Leeder was issued with the Community Protection Notice in June 2020 due to ongoing complaints from neighbours alleging noise nuisance from loud music being played from her home which was having a significant impact to others in the locality.
The Council’s Community Safety Team had tried to resolve the concerns informally by providing advice, support and informal warnings, however this advice was ignored, and she was served a Community Protection Notice.
Following further complaints and visits to the address, it was established that Leeder continued to disregard the Council’s advice and continued to cause a nuisance from her address. This subsequently led to the Council applying to the courts for breaching a statutory notice.
At the hearing, Leeder was found guilty of the offence under the legislation of failing to comply with the notice that required her to cease playing amplified music/radio or instruments, at such a volume as to cause annoyance and nuisance to others. This resulted in a fine of £440.00, surcharge to fund victim services of £44.00, and additional court costs of £455.47, Totalling £939.47.
Cllr Helen-Ann Smith, Cabinet Member for Community Safety and Crime Reduction, said :
“Jade Leeder was causing misery to her neighbours, so this is a really positive result. I hope this acts as a deterrent to other residents that think it’s ok to play loud music behave anti-socially.
“The Council is committed to making our communities nice places to live. We have proven time and time again that we will pursue enforcement action whenever we can to ensure that the behaviours of a few people don’t impact other resident’s lives.”
